These Terms of Service ("Terms") govern your use of the Kristall Klear Home Delivery Club website and your subscription to our water delivery service, operated by FirstBev Limited ("we", "us", "our"). By submitting the subscription form you agree to these Terms.
1. The Service
The Delivery Club provides scheduled deliveries of Kristall Klear Premium Water to homes, offices, schools, churches, hotels and businesses within our service areas in Nigeria. Delivery availability depends on your location.
2. Eligibility
You must be 18 years or older, or an authorised representative of an organisation, to subscribe. You agree to provide accurate, current and complete information when registering.
3. Subscriptions and Deliveries
- Your chosen subscription plan, frequency and preferred delivery day will be confirmed by our customer representative after registration.
- Delivery dates may shift due to public holidays, weather, traffic or logistics issues. We will make reasonable efforts to notify you of changes.
- Someone aged 18 or older should be available at the delivery address to receive and sign for the water. If no one is available, redelivery may be attempted on the next available day.
4. Pricing and Payment
Prices, deposits and packaging charges (for example bottle and dispenser deposits) will be communicated by our representative before your first delivery and may be revised from time to time. You agree to pay all amounts due using the payment methods we accept.
5. Cancellations and Pauses
You may pause or cancel your subscription at any time by contacting us through the WhatsApp or phone number on our home page. Changes take effect from the next scheduled delivery once confirmed.
6. Packaging and Returns
Bottles, dispensers and other refillable packaging remain our property unless explicitly sold to you. You agree to return them in reasonable condition. Lost or damaged packaging may be charged at the applicable replacement rate.
7. Product Quality
Kristall Klear Premium Water is produced under our quality and safety standards. If you ever receive a product that appears damaged or tampered with, please stop using it and contact us immediately for a replacement.
8. Acceptable Use
You agree not to misuse the website or service, including by attempting to interfere with its operation, submitting false information, or reselling our water without our written permission.
9. Limitation of Liability
To the maximum extent permitted by law, FirstBev Limited is not liable for indirect or consequential losses arising from delivery delays or service interruptions outside our reasonable control. Our total liability for any claim relating to the service is limited to the amount you paid us in the three months before the claim.
10. Changes to the Service or Terms
We may update the service or these Terms from time to time. Material changes will be communicated through the website or directly to subscribers. Continued use of the service after changes take effect means you accept the updated Terms.
11. Governing Law
These Terms are governed by the laws of the Federal Republic of Nigeria. Any dispute will be resolved in the courts of competent jurisdiction in Nigeria.
